Commercial use and ownership

Last updated: October 12, 2026

What you upload to Layer stays yours, and what you generate in Layer belongs to you as the customer, for personal and commercial use. This page sums up what our Terms of Service say about ownership and use. The Terms are what apply; where this page and the Terms differ, the Terms win.

If your studio signed an order form or a master services agreement with Layer, that agreement may set different terms. Check it, or ask whoever manages your Layer contract.

Who owns what

What you upload

Images, designs, audio, video and anything else you or your team share with Layer is Customer Content, and the prompts and files you give a model are Input. As between you and Layer, all rights in your Customer Content remain with you (Terms, section 6.1). You give Layer, and the providers directly involved in running the service, a licence to process it only so we can provide the service, support you and meet legal requirements (section 6.2).

What you generate

The output Layer generates from your input (images, video, audio, meshes, and edits of your own files) is Generated Content. As between you and Layer, you own all rights, title and interest in it, to the extent Layer has such rights and they exist under applicable law, and subject to your compliance with the Terms, including paying any fees. Layer gives up any rights it might have in your Generated Content, without promising what rights exist in it (section 7.2).

Reference sets, workflows and trained models

Reference sets, workflows, LoRAs, brand kits and other materials you create, configure or train in Layer count as Generated Content. Files you upload unchanged count as Input (section 7.3). Either way, they are yours as described above.

Your studio's workspace

The customer is whoever accepted the Terms: you, if you signed up for yourself, or your company, if you work in its workspace. If you sign up with an email address on your employer's domain, your account may be moved into your employer's business account, after which your employer is the customer for it and its admins control it, including its content (section 3.2).

Using what you make

Commercial use

The Terms let you use Layer for your lawful personal and commercial purposes (section 2.1), and you own your Generated Content as described above. Ship it in a game, an ad, a trailer or a store listing.

Model licences

Generated Content and its use may be subject to the licence and use restrictions of the model that made it (section 7.2). You choose the model for every run, so check a model's terms when a project has specific requirements.

Similar outputs

Generative models can return the same or similar output for the same or similar input, so your Generated Content may not be unique. Your ownership does not extend to output another customer generated (section 7.2).

What is not allowed

You may not use Generated Content to build or train a product or service that competes with Layer, or to train a generative AI model that competes with the model that made it (section 7.8). Everything you upload and generate must also follow our Acceptable Use Policy, which rules out, among other things, uploading or generating material that infringes someone else's intellectual property.

What it means for you

  • Upload only material you have the rights to. You confirm that you hold the licences and permissions for everything you share with Layer (section 6.3), and you are responsible for claims that your content or your Generated Content infringes someone else's rights (section 12).
  • Review before you ship. You are responsible for checking that Generated Content is accurate, lawful and appropriate before you use or share it, with human review where you need it (section 7.2).
  • Keep your own copies. Layer is not a storage, backup or archiving service, so keep the files you ship in your own storage (section 3.5).
  • Layer does not train models on what you upload. See How Layer handles your data.
